HOW WE COMPLY

TRAVEL AND SUBSISTENCE LEGISLATION

Introduced as part of the Finance Act of 2015, this legislation aims to restrict the tax relief that workers can receive on their travel and subsistence expenses as of 6th April 2016. Those workers that are found to engage under supervision, direction and control will be affected but for many,  this tax relief may still be available.

Clipper Contracting provides a range of solutions for all workers that are fully compliant with government legislation and HMRC guidelines

FALSE SELF-EMPLOYMENT LEGISLATION

In response to surge in workers engaging on a self-employed basis when the nature of their work would dictate they should be operating as employees, legislation was introduced in 2014 to encourage recruitment agencies to ensure their workers are genuinely self-employed.

Clipper Contracting provides an assessment based framework to assist recruitment agencies in identifying genuinely self-employed workers.

WORKPLACE PENSION SCHEME

As of October 2012, all employers will have to automatically enrol their employees over the age of 22 that earn above the annual tax free allowance amount, into a pension scheme. All but the truly self-employed will need to be enrolled, with the employer also making a contribution.

Clipper Contracting uses
Nest Pensions as our pension provider and offer all of our employees a pension scheme.

EMPLOYMENT INTERMEDIARIES LEGISLATION

Introduced in April 2014, with the reporting function operational as of April 2015, it centres on whether someone who operates through an intermediary is genuinely self-employed. The intermediary has a responsibility to report to HMRC each quarter, on how each worker is engaged, be it PAYE, on a self-employed basis or through a PSC. There are heavy fines for those that don’t report this information accurately.

Clipper Contracting provides each agency with an intermediary report scheduled for each quarter when it is due for submission.

AGENCY WORKERS REGULATION (AWR)

This legislation was introduced in 2011 as a vehicle to ensure working and employment conditions of contractors and freelancers engaged through recruitment agencies are no different to a ‘comparable worker’ – a full-time employee doing the same job in the same workplace. The entitlements covers include basic pay, bonuses, annual leave and benefits.

Clipper Contracting provide notifications when a worker is approaching the 12 weeks.
