Seasonal Worker Migrant Visas - are you coming across them?

We've seen a recent uptick in enquiries as to whether the Seasonal Worker Visa provides eligibility to work in the UK. These enquiries are coming from recruiters not typically associated with providing workers to the horticultural industry.


So what is this visa?

The visa (like the one detailed on the left), allows seasonal migrants to work in the UK for up to 6 months in a 12 month period within the Horticultural sector, for example as fruit pickers.


It is not a route to permanent settlement in the UK and requires the worker to carry out work with a sponsor who is an approved scheme operator.


The enquiries we have been receiving have thus far been from recruiters within the construction sector. Individuals with this visa have also applied for their CSCS card (a card showing an individual has the necessary qualifications or basic H&S training) demonstrating an attempt to find work in this sector.


Unfortunately, workers with this migrant visa are not allowed to work in the construction industry, or any other industry other than the horticultural industry. You should therefore be very careful before contemplating placing them on a new assignment for which this visa may not be valid.
